These Terms and Conditions, along with privacy policy or other terms (“Terms”) constitute a binding agreement by and between TRAVEL EMPOWERS, ( “Website Owner” or “we” or “us” or “our”) and you (“you” or “your”) and relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, “Services”).
By using our website and availing the Services, you agree that you have read and accepted these Terms (including the Privacy Policy). We reserve the right to modify these Terms at any time and without assigning any reason. It is your responsibility to periodically review these Terms to stay informed of updates.
The use of this website or availing of our Services is subject to the following terms of use:
- To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your registered account.
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. - Your use of our Services and the websiteis solely at your own risk and discretion.. You are required to independently assess and ensure that the Services meet your requirements.
The contents of the Website and the Services are proprietary to Us and you will not have any authority to claim any intellectual property rights, title, or interest in its contents. - You acknowledge that unauthorized use of the Website or the Services may lead to action against you as per these Terms or applicable laws.
You agree to pay us the charges associated with availing the Services.
You agree not to use the website and/ or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or Indian or local laws that might apply to you. - You agree and acknowledge that website and the Services may contain links to other third party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third party websites.
You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the us for the Services. - You shall be entitled to claim a refund of the payment made by you in case we are not able to provide the Service. The timelines for such return and refund will be according to the specific Service you have availed or within the time period provided in our policies (as applicable). In case you do not raise a refund claim within the stipulated time, than this would make you ineligible for a refund.
- Notwithstanding anything contained in these Terms, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.
These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India. - All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in KALIMPONG KHASMAHAL, West Bengal

QUOTE, RATES & VARIATIONS
Our quotation system accesses both real-time (dynamic) and static pricing depending on our suppliers. It is not uncommon for suppliers—such as airlines, cruise liners, or hotels—to alter, withdraw, or sell out of advertised rates or promotions without prior notice. If the quoted price, inclusions, or rates vary before your booking is confirmed and payment processed, we will notify you of any such changes. You may choose to cancel the booking request at this stage without any penalty.
Please note that once a booking is confirmed and payment is received, newly released promotions or discounts cannot be applied retrospectively. We reserve the right to vary the final price in the event of changes in exchange rates, supplier pricing, taxes, or other regulatory factors prior to full and final payment.
In cases where a price increase occurs due to currency fluctuations, tax revisions, or supplier-imposed changes, the client is obligated to pay the difference. Rates quoted are specific to the travel product at the time of quotation and may change based on availability and other market conditions without prior notice.
PAYMENT & DEPOSIT
Standard Bookings (Travel beyond 60 days):
A 50% deposit is required at the time of booking confirmation.
The remaining balance is due 45 days prior to travel or by the due date mentioned in the invoice, whichever is earlier.
Payments may be made via bank transfer, credit/debit card (note: card processing fees may apply).
Final travel documents and confirmations will only be issued once the total payment is received.
Failure to pay the balance by the due date will result in automatic cancellation of the booking and forfeiture of the deposit. We reserve the right to auto-debit the balance from the card provided.
Festive Season Bookings (20th December – 5th January / Diwali Trips):
A non-refundable 25% deposit is required at the time of confirmation.
Final payment is due 60 days prior to departure.
This deposit is only refundable if the tour is not operational or the dates are not confirmed by us.
Payment Terms Summary:
50% deposit upon confirmation of bookings/services via email or status chart.
Remaining balance due 45 days before departure or as per the invoice due date.
We strongly recommend that all clients obtain comprehensive travel insurance, especially when traveling to India.
CANCELLATION & REFUNDS
All cancellations must be communicated in writing to our office during working hours on working days. If the booking form has been signed by one or more individuals on behalf of a group, written communication from the signatory will be considered valid for the entire group.
The effective date of cancellation will be the date on which the written notice is received at our office. In case of cancellations, any amount already spent by the Company on flight bookings, visa processing, medical insurance, and administrative charges will be non-refundable and additionally payable by the client.
For bookings involving third-party services, their specific cancellation policies will apply, along with any service and communication fees charged by us.
Please note: Cancellations can be due to any reason (including personal issues such as illness, death, legal restrictions, or documentation problems), and standard cancellation rules will apply uniformly.
Cancellation Charges:
More than 45 days prior to arrival: 15% of the tour/service cost
30 to 44 days prior to arrival: 50% of the tour/service cost
15-29 days prior to arrival: 75% of the tour/service cost
Less than 15 days prior to arrival: 100% of the tour/service cost (no refund)
Non-Refundable Periods:
All bookings during Christmas & New Year (20 Dec – 05 Jan) and Diwali Festival Trips are non-refundable under any circumstances.
